Terms and Conditions:

  1. This agreement also constitutes a model release for the subjects stated on this agreement.
  2. Session Fees and Print Prices in effect at the time of session booking will apply.
  3. The booking fee is non-refundable due to cancellation; however a new session may be re-scheduled within four weeks at no additional charge.
  4. Balance of  session fee and travel/accommodation expenses is payable on or before the session date.
  5. The session will take 1-3 hours at the Photographer’s discretion and determined by the number, age and degree of co-operation of the subjects.  Additional time is chargeable at $30.00 per half hour.
  6. A minimum of twenty of the best photographs will be selected at the Photographer’s discretion and carefully processed and hand edited to the Photographers artistic satisfaction.  Photographs that do not meet the Photographers technical and artistic requirements duplicate or unflattering images will be deleted from the system.
  7. Under normal circumstances the final images will be made available online within two weeks of the session date and will be available for print ordering for three weeks before being archived.  Archived galleries may be re-instated for a further two weeks on payment of a recovery fee of $40.00.
  8. Full copyright ownership for all images remains with the Photographer/South West Photography.  Photographs may not be scanned, reprinted, edited or duplicated in any way without express permission from the Photographer/South West Photography.
  9. Only digital images provided and watermarked by the Photographer may be shared online by email, on websites, Facebook etc.  Web size images can be purchased expressly for this purpose.
  10. Full copyright, re-print permission and high resolution digital images may be purchased for $100.00 per image or $700.00 for all final images from the session.
  11. The photographer/South West Photography reserves the right to use and display photographs for publicity, advertising, promotional, marketing, portfolio and competition purposes in print and on the internet.
  12. The Photographer/South West Photography will not sell the photographs as ‘stock photographs’ without express written permission from the client.
  13. If the Photographer/South West Photography cannot perform this Agreement due to any
    casualty, technical malfunction, illness, act of nature or any other cause, the client may elect to have another photography session or have any deposit already paid returned in full and the Photographer shall have no further liability with respect to the Agreement.
  14. Any changes or alterations to this Agreement must be agreed upon by both parties in writing and attached to this Agreement.

 

Signing this agreement constitutes full understanding and agreement to the Terms and Conditions as stated herein.
